mat-de-misaine.com is a website. It is published and operated by the company MAT DE MISAINE.

The General Terms and Conditions presented here establish the rights and obligations incumbent on the various parties in the context of the online sale of products and services offered by mat-de-misaine.com. Users must have read these General Terms and Conditions and declare that they have accepted them in order to benefit from the mat-de-misaine.com offer.

Article 1: Glossary

A "user" is any person who has accepted these General Conditions, registered on mat-de-misaine.com, and wishes to enjoy the privileges of mat-de-misaine.com. Only users may access sales.

“Order” means the purchase of a product on mat-de-misaine.com.

“Discount code” means the value of the discount that MAT DE MISAINE grants to a user when making a purchase on MAT DE MISAINE.

“Gift voucher” means the value of the discount that a MAT DE MISAINE user acquires when making a purchase on mat-de-misaine.com.

Article 2: Navigation on the site / Creation and use of the customer account

The future user declares and guarantees that he or she has the legal capacity to enter into a contract or commitment, is 18 years of age or older, or has the authorization of a person with parental authority, a guardian or curator if he or she is a minor or incapable.

Browsing the site and viewing the Product presentation pages do not require any registration on the part of the user.

To be able to place an order on the site, the user can:
- create a personal account on the site by completing the registration form provided for this purpose;
- identify themselves using their email address and the password they chose when their personal account was already created;
- order as guest.

The information provided by the user during registration must be accurate, complete and up-to-date. In particular, the user must ensure that the email address provided during registration is valid and up-to-date.

This address is in fact considered a valid personal address to which all emails sent by MAT DE MISAINE in the context of the execution of these terms and conditions will be sent and will also be used as the user's login ID on the site.

To create a personal account, users must provide all mandatory information, which is marked with an asterisk. Failure to provide this information will result in the user's registration not being processed.

In any event, the user is responsible for the information entered on their registration form. In the event of an error, MAT DE MISAINE cannot be held responsible for any failures caused in the processing of the order due to the user's failures.

The user's email address and password are strictly personal and confidential, and the user is prohibited from disclosing them to a third party or transferring them. Any order placed using this username and password will be deemed to have been made by the user and will therefore bind the latter to MAT DE MISAINE. It is the user's responsibility to immediately inform MAT DE MISAINE in writing of any use of their email address and password made without their knowledge and of which they become aware.

Article 3: Order

To purchase, the user will need to complete an order form.

By clicking on the "add to cart" button during the ordering process, and after having checked the contents of the order in his "cart" and, if necessary, having modified it, the purchasing user declares to accept fully and without reservation all of these General Conditions of Sale. The action of the user validating the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

The Seller, after receiving payment authorization under the conditions of Article 5, automatically sends an order confirmation to the Buyer's email inbox.

Article 4: Archiving

Purchase orders and invoices are archived on a reliable and durable medium stored in the Seller's computer systems.

The purchasing user can have access to the purchase orders and invoices concerning him electronically, upon simple request.

Article 5: Payment terms

Payment for purchases is made at the time of ordering, by credit card. CB, Visa, Mastercard, and American Express credit cards are accepted. The customer will be charged within one week of order confirmation.

Once payment is validated by the banking center, the order becomes effective. In the event of a bank refusal, mat-de-misaine.com will automatically cancel the current order.

All banking transactions are secured thanks to the Shopify Payments secure payment solution, which ensures the encryption of your personal data in compliance with the various banking regulations applicable in France.

mat-de-misaine.com does not have access to your confidential banking information at any time.

Article 6: Displayed prices

Products are invoiced according to the current price list indicated on the website on the day of the order. Prices are indicated in euros and include all taxes. The applicable VAT is the one in effect at the time of invoicing for countries located within the European Union. Outside the European Union, prices are exclusive of taxes. Additional charges such as customs duties, value-added tax, and other taxes may apply depending on the country and are the responsibility of the customer.

The prices indicated do not include the delivery costs of the products, invoiced in addition and clearly indicated to the user before confirming their order when choosing their delivery.

The total price of the order is in any case indicated at the end of the online order, before its validation.

MAT DE MISAINE reserves the right to modify its sales prices at any time. However, MAT DE MISAINE cannot apply any changes made after the order has been placed. The price applicable to the products ordered is the one appearing on the website on the day the order is placed.

Article 7: Disputes

MAT DE MISAINE reserves the right to interrupt a transaction with a user for whom a dispute has already been identified.

MAT DE MISAINE reserves the right to cancel a delivery or to cancel an order placed by a user for whom a resolved or ongoing dispute is identified.

In addition, MAT DE MISAINE reserves the right to request a photocopy of the buyer's identity card and/or bank card (front only) and/or bank details for any payment by bank card and/or any information relating to the buyer's identity. You have the right to access, rectify, and delete your personal data.

As part of the fight against Internet fraud, information relating to the Buyer's Order may be transmitted to any third party authorized by law or designated by MAT DE MISAINE for the sole purpose of verifying the Buyer's identity, the validity of the Order, the payment method used and the planned delivery.

Article 8: Delivery

Deliveries are made to Germany – Australia – Austria – Belgium – Denmark – Spain – United States – Finland – France – Greece – Ireland – Italy – Luxembourg – New Zealand – Netherlands – Portugal – Czech Republic – United Kingdom – Sweden

For delivery in mainland France, the customer can choose one of the following delivery methods:

• Home delivery (Colissimo)
• Delivery to Parcel Relay
• Delivery to post office
• Delivery to MAT DE MISAINE store (subject to product availability)

The customer can choose to have their order delivered to the MAT DE MISAINE stores offered for this delivery method. They will be informed by email when their order is available. They will then have 10 days to collect it. When they visit the store, they will have the opportunity to try on their item. To collect it, they will need to present a valid ID card and sign a copy of the delivery slip. Please note that a third party may collect their order upon presentation of a photocopy of their ID and a signed document certifying that they are authorized to collect the order. To obtain their invoice, they simply need to log in to their customer account on their website using their usual login details.

MAT DE MISAINE offers international delivery via Colissimo International.

Delivery costs are specified at the time of ordering. They may depend on the type of product concerned (weight, size, etc.). The delivery rates advertised include VAT.

Within the limits of available stocks, the parts will be delivered within the time announced on the site from the closing of the sale and after validation of the order by the Buyer.

If a new order is required, the shipping time will be set at 25 working days from the closing of the sale and after validation of the order by the Buyer.

In all cases, the delivery time is specified at the time of ordering.

In the event of a delay exceeding 7 days, the user will have a period of 60 days from the date indicated for delivery to exercise his right to cancel the sales contract by registered letter with acknowledgment of receipt, in accordance with the law of January 18, 1992.

MAT DE MISAINE declines all responsibility for failure to meet delivery deadlines due to unforeseeable or insurmountable actions by the carrier (particularly in the event of loss of products or strikes).
After a 30-day investigation, if the package is considered lost, MAT DE MISAINE will reimburse the customer for the full amount of the lost order.

Upon receipt of the package, it is the recipient's responsibility to check the conformity of the product and to note on the delivery slip any damage caused by the carrier.

Article 9: Right of withdrawal and return of products

In accordance with Article L. 121-20 of the Consumer Code, the customer has a withdrawal period of 30 working days following receipt of the package to return or exchange it.

The right of withdrawal also applies once the order has been placed and before delivery of the product.

Products must be returned in perfect condition (unworn, unwashed, unaltered), with their original label and packaging.

Return costs are free from mainland France and Corsica.

In the event of a defective item or one that does not conform to the order, the customer must notify the Seller in writing within 30 working days of receiving the order. The products must be returned in perfect condition (unworn, unwashed, unaltered), with their original label and packaging.

Return shipping is free from mainland France and Corsica. For international orders, return shipping costs will be refunded provided you include proof of shipping costs with the package.

Items returned after the deadline will not be refunded or exchanged and will be returned to the customer. MAT DE MISAINE will not accept returned products that are damaged, incomplete, or used. Packages without any attachments that allow the user to be identified (order number, name, etc.) will not be accepted. MAT DE MISAINE may refuse packages sent after the right of withdrawal has expired.

Reimbursement to the customer's bank will take place within a maximum of 30 days from the request for withdrawal or return. No credit will be issued.

Article 10: Product warranty

In the event of a technical problem, mat-de-misaine.com invites its users to contact customer service via the contact form available on the Site or by email at eshop@mat-de-misaine.com

Article 11: Gift vouchers and discount codes

Gift vouchers or discount codes may be offered by mat-de-misaine.com. They cannot be combined and apply only to sales on mat-de-misaine.com. They are valid according to the conditions indicated on the gift voucher or associated promotional offer.

Gift vouchers cannot be refunded in cash under any circumstances. They are non-refundable in the event of cancellation or product return. No gift voucher or promo code will be refunded by mat-de-misaine.com once used.

Discount codes are automatically deducted from your order total during the final step of your order. After confirming your cart, the discount amount must appear on your order form to be taken into account.

Article 12: Copyright

The site and its content are subject to legal protection under literary and artistic property (copyright) and industrial property (trademarks, designs and models). Use of the site is limited to the consultation, editing and/or printing of all or part of the site for strictly individual and private use.

Any reproduction or distribution of elements of the site for commercial purposes, as well as any modification, reuse or incorporation of these elements into other works is prohibited, except with the express written authorization of MAT DE MISAINE. Failure to comply with these rules may incur the civil and criminal liability of the offender.

Article 13: Applicable law - Disputes

These Conditions of Sale are subject to French law.

Article 14: Payment in installments with Alma

Payment by installments/deferred payments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Amount of purchases

P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
Costs
By paying in installments with Alma, the Customer does not pay any fees. Except in the following cases:

P3X: 3.80% per transaction
Alma is a telepayment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

Termination
Any termination of the General Terms and Conditions which bind the Seller and the customer, results in the termination of the General Terms and Conditions between Alma and the customer.
